1. Acceptance of Terms

These Terms and Conditions ("Terms") govern access to and use of Tinkly AI, owned and operated by Shivi Learning Private Limited. By accessing, browsing, registering on, purchasing from, or using the Platform, you agree to be bound by these Terms, the Privacy Policy, and the Refund / Cancellation / Delivery Policy.

2. Eligibility

Users must be legally competent to enter into a binding contract under applicable law. If a user is under 18 years of age, use of the Platform must occur with the involvement and supervision of a parent or lawful guardian. Paid purchases for minors must be made by a parent or lawful guardian.

3. Services

Tinkly AI may provide digital educational services including coding lessons, AI learning content, projects, games, subscriptions, assessments, workshops, and related online resources. We may modify, expand, suspend, or discontinue any part of the Platform at our discretion.

4. Accounts and User Responsibility

• users must provide accurate, current, and complete information;
• users are responsible for maintaining account confidentiality;
• users remain responsible for all activity conducted through their account;
• we may suspend or terminate accounts that are false, unlawful, abusive, or risky to the Platform or other users.

5. Payments and Billing

Certain services are paid. By making a purchase, the user agrees to pay the fees, taxes, and charges displayed at checkout. Payments may be processed through third-party providers such as Razorpay. A transaction is considered complete only after successful payment confirmation and acceptance by our systems.

6. Subscription Terms

Where a subscription is purchased, the duration, scope, and pricing will be shown at checkout. If auto-renewal is enabled, the user authorizes recurring charges until cancellation. Cancellation stops future billing only and does not create a refund for the current billing cycle unless required by law or expressly approved by us.

7. No-Refund Rule

All purchases are generally final and non-refundable except in the limited cases described in the Refund / Cancellation / Delivery Policy, including duplicate payments, non-delivery caused solely by our fault, or where a refund is required by applicable law.

• no account sharing beyond the permitted user scope;
• no malware, spam, or attempts to disrupt platform security or performance;
• no infringement of our intellectual property or third-party rights.

9. Intellectual Property

All software, text, graphics, brand assets, learning materials, curriculum structures, animations, interfaces, and related content on Tinkly AI are owned by or licensed to Shivi Learning Private Limited and are protected under applicable intellectual property laws. Users receive only a limited, non-exclusive, non-transferable, revocable license for personal and lawful educational use.

10. Disclaimers and Liability

The Platform is provided on an “as is” and “as available” basis to the fullest extent permitted by law. We do not guarantee uninterrupted availability, error-free performance, or any specific educational outcome. To the fullest extent permitted by law, our aggregate liability arising from the Platform or a paid service will not exceed the amount actually paid for the specific service giving rise to the claim in the twelve months preceding the event.

11. Governing Law and Jurisdiction
